APEX LENS MEDIA LLC
TERMS & CONDITIONS
Effective Date: August 17, 2026
By placing an order, scheduling services, submitting property information, or accepting delivery of any products or services from Apex Lens Media LLC (“Apex Lens Media,” “Company,” “we,” “us,” or “our”), the client (“Client,” “you,” or “your”) agrees to the following Terms & Conditions.
1. Services
Apex Lens Media provides professional real estate photography, aerial/drone photography and video, property video, 360° imagery, floor plans, virtual tours, social media content, and other real estate media services as described in the applicable order.
Services provided are limited to the products specifically included in the Client’s order. Any additional services, products, revisions, travel, rush delivery, or other requests may be subject to additional fees.
2. Scheduling & Property Access
The Client is responsible for providing accurate property information and ensuring that Apex Lens Media has lawful and timely access to the property at the scheduled appointment.
The Client is responsible for ensuring that the property is reasonably prepared for photography and that occupants, tenants, contractors, pets, vehicles, or other items that the Client does not wish to appear in the media are appropriately removed or secured before the appointment.
Apex Lens Media is not responsible for photographing or editing out conditions that were present at the time of the shoot unless such editing is specifically included in the ordered service.
3. Weather & Drone Operations
Aerial/drone services are subject to weather, airspace restrictions, FAA requirements, equipment limitations, safety considerations, and other conditions outside the Company’s control.
Apex Lens Media reserves the right to postpone, modify, or cancel aerial operations when conditions are determined to be unsafe, unsuitable, or legally restricted. When reasonably possible, the Company will coordinate a rescheduled appointment with the Client.
The Company does not guarantee a particular weather condition, lighting condition, sunset, sunrise, foliage condition, or other environmental appearance.
4. Creative & Editing Control
Apex Lens Media retains professional and creative discretion regarding photography, videography, composition, color correction, exposure, cropping, retouching, sequencing, music selection, and other aspects of post-production.
The Client understands that delivered media represents the Company’s professional creative judgment.
Minor variations in color, exposure, composition, perspective, or editing are not considered defects or grounds for a refund.
5. Final Products & Revisions
The products delivered to the Client constitute the final edited products unless otherwise stated in the order.
Any requested revisions must be submitted within 48 hours of delivery and may be subject to additional charges depending on the nature and extent of the requested changes.
Apex Lens Media is not obligated to provide revisions resulting from a Client’s change of preference after approval or delivery of the final product.
6. No Alteration of Delivered Media
The Client may not alter, modify, filter, crop, recolor, retouch, manipulate, distort, overlay, re-edit, or otherwise modify any photograph, video, aerial image, floor plan, virtual tour, or other final media delivered by Apex Lens Media without the Company’s prior written permission.
This includes, but is not limited to, applying filters, changing colors, removing or adding objects, altering skies, adding graphics or logos directly onto the media, substantially cropping or reframing images, or using third-party editing software or services to modify the delivered work.
If a modification is desired, the Client may request that Apex Lens Media perform the modification, subject to availability and applicable fees.
7. Copyright & Ownership
Unless expressly agreed otherwise in a separate written agreement signed by Apex Lens Media, Apex Lens Media LLC retains all copyrights and intellectual-property rights in photographs, videos, aerial imagery, floor plans, virtual tours, graphics, and other original media created by the Company.
Payment for services does not constitute a transfer of copyright or ownership.
The Client receives a non-exclusive license to use the final delivered media for the marketing, advertising, promotion, and sale or lease of the property for which the media was commissioned.
The Client may not sell, sublicense, transfer, redistribute, or commercially license the media to another party except as reasonably necessary for marketing the property, including use by the property owner, listing brokerage, MLS, real estate websites, social media platforms, print advertising, signage, and other customary real estate marketing channels.
8. Company Marketing & Promotional Rights
Apex Lens Media LLC expressly reserves the unrestricted right to use, reproduce, publish, display, distribute, and otherwise utilize photographs, videos, aerial imagery, floor plans, virtual tours, and other content created by the Company for its own business purposes, including marketing, advertising, promotion, portfolio development, website content, social media, print materials, demonstrations, awards, competitions, and other promotional activities.
These rights survive delivery of the final products and payment by the Client.
The Client acknowledges that no additional compensation is owed for the Company’s use of the media for these purposes.
9. Raw Files & Unselected Media
Unless specifically purchased or agreed to in writing, Apex Lens Media is not required to provide RAW photographs, unedited video footage, project files, source files, rejected images, duplicate images, or other unprocessed materials.
The Company’s obligation is limited to delivery of the final products specified in the Client’s order.
10. Delivery
Delivery will generally be made electronically through the Company’s designated delivery platform or another method selected by Apex Lens Media.
Delivery is considered complete when the final products have been made available to the Client through the designated delivery method.
The Client is responsible for providing accurate contact information and maintaining access to the email address, delivery platform, or other account used to receive the products.
11. Payment
Payment is due in full no later than twenty-four (24) hours after the final products have been delivered to the Client.
Apex Lens Media may require payment before services are performed for certain orders, new clients, rush services, or other circumstances determined by the Company.
The Company reserves the right to suspend delivery, revoke access to delivered media, withhold future services, or pursue collection of unpaid balances when payment is not received according to these Terms.
Any applicable late fees, collection costs, or other charges will be disclosed to the Client before being assessed.
12. Cancellations & Rescheduling
The Client should provide as much advance notice as reasonably possible when cancelling or rescheduling an appointment.
Appointments cancelled or rescheduled with insufficient notice may be subject to a cancellation, rescheduling, or trip fee at the Company’s discretion.
Apex Lens Media reserves the right to reschedule appointments when circumstances outside the Company’s reasonable control make performance impractical or unsafe.
13. Property Conditions & Accuracy
Apex Lens Media does not guarantee that photography or video will conceal, correct, or otherwise compensate for property defects, construction issues, damage, clutter, weather conditions, neighboring properties, power lines, utility infrastructure, road conditions, or other circumstances outside the Company’s control.
The Client is responsible for the accuracy of all property information supplied to Apex Lens Media.
Apex Lens Media is not responsible for inaccuracies in property information, measurements, descriptions, floor plans, MLS information, or other materials supplied or approved by the Client.
14. Floor Plans, Measurements & Virtual Tours
Where applicable, floor plans, measurements, room dimensions, virtual tours, and similar products are provided for marketing purposes and should not be considered architectural, engineering, surveying, appraisal, or legal documents unless expressly stated otherwise.
The Client is responsible for independently verifying measurements or other information when accuracy is legally or professionally required.
15. Client Authorization
The Client represents that they have the legal authority or permission necessary to authorize Apex Lens Media to photograph, record, access, and otherwise create media of the property.
The Client is responsible for obtaining any necessary permissions from property owners, tenants, occupants, homeowners’ associations, property managers, or other parties.
16. Limitation of Liability
To the fullest extent permitted by applicable law, Apex Lens Media LLC will not be liable for indirect, incidental, consequential, special, or punitive damages arising from or related to the Company’s services.
Apex Lens Media’s maximum liability for any claim arising from a particular order will not exceed the amount actually paid to Apex Lens Media for the specific services giving rise to the claim.
The Company is not responsible for delays or failures caused by circumstances beyond its reasonable control, including severe weather, natural disasters, accidents, illness, equipment failure, power or internet outages, government restrictions, FAA restrictions, airspace closures, acts of God, or other force majeure events.
17. Third-Party Platforms
Apex Lens Media may use third-party platforms and services for editing, hosting, delivery, scheduling, virtual tours, storage, payment processing, or other business functions.
The Company is not responsible for outages, technical failures, policy changes, data loss, or other issues caused by third-party platforms outside the Company’s reasonable control.
18. Client Indemnification
The Client agrees to indemnify and hold harmless Apex Lens Media LLC, its owners, employees, contractors, and agents from claims, damages, liabilities, or expenses arising from the Client’s failure to obtain required permissions, inaccurate information supplied by the Client, unsafe property conditions known or reasonably discoverable by the Client, or unauthorized use or modification of the Company’s media by the Client or third parties acting on the Client’s behalf.
19. Agreement & Acceptance
By submitting an order, scheduling services, authorizing work, making payment, or accepting delivered products, the Client acknowledges that they have read, understood, and agreed to these Terms & Conditions.
These Terms & Conditions, together with the applicable order details and any separate written agreement signed by both parties, constitute the agreement between the Client and Apex Lens Media LLC concerning the ordered services.
If any provision of these Terms & Conditions is determined to be unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
20. Changes to Terms
Apex Lens Media LLC reserves the right to update or modify these Terms & Conditions from time to time. The Terms in effect at the time an order is accepted will govern that order unless otherwise agreed to in writing.
By placing an order with Apex Lens Media LLC, the Client acknowledges and agrees to these Terms & Conditions.
